05.11 pm : Nizar baru selesai mengadakan sidang akhbar di luar mahkamah. Antaranya beliau yakin keputusan hakim esok akan berpihak kepadanya.
04.55 pm : Appeals Court will deliver judgment on Zambry’s appeal at 3.30pm Friday May 22.
04.45 pm : Tun Majid rebuts on behalf of AG’s Chambers.
04.43 pm : Cecil argues that there is more than one way to dismiss the MB and it is not only by majority vote.
04.38 pm : Peguam Zambry, Cecil sedang membuat hujah balas.

04.10 pm : Sulaiman ends submission by urging judges not to change findings of trial judge.

04.03 pm : Sulaiman berhujah Nizar menghadap Sultan Perak untuk memohon pembubaran DUN mengikut peruntukan Perkara 36 (c) Undang-Undang Tubuh Perak, bukan mengikut Perkara 16 (6) seperti yang dihujahkan Cecil.
03.55 pm :Sulaiman says not challenging ruler’s prerogative but impossible to conclude loss of confidence in Nizar to make him resign.
Everything is still under control here but it looks like a bit cloudy outside.

12.59 pm : AG completes submission. Court adjourns and continues after lunch with Nizar’s cousel Sulaiman Abdullah.
12.28 pm : Gani says if put to vote, Nizar would have lost. (Kenyataan bodoh dari AG, dia sendiri mengaku BN tak pernah undi tak percaya kat Nizar pun)
12.20 pm :Gani says at 28-28, Pakatan Speaker cannot vote & even without 3 independents, Pakatan would have only 27 votes in assembly.

11.59 am : Selepas ini bermula pada jam 12.15 petang, peguam DS.Nizar, Hj. Sulaiman Abdullah akan mengemukakan penghujahannya.

11.25 am : Cecil argues if MB does not resign at ruler’s request, then the constitution dismisses him under Article 16 (6)
Article 16(6) of the Perak Constitution. This article provides that where a request for dissolution is made as a consequence of the menteri besar ceasing to command the confidence of the majority of the members of the assembly and His Highness refuses, the incumbent menteri besar must tender the resignation of the Executive Council.
It must be borne in mind that:
- as noted above, Article 16(6) is specifically directed to a no-confidence scenario, that is the incumbent menteri besar can seek the dissolution of the assembly upon his having ceased to command the confidence of the majority
- Article 36(2) however provides more generally that His Highness has the power to dissolve the assembly. It is clear that this provision is aimed at allowing His Highness to dissolve the assembly for other reasons thought to be appropriate
- as a matter of law His Highness is empowered to do what is permitted under the Perak Constitution and the Federal Constitution. This is the essence of a constitutional monarchy
- the Perak Constitution does not empower His Highness to dismiss the menteri besar. The manner in which the menteri besar is to be removed from office is as provided for under Article 16(6), through a refusal to dissolve the assembly at the request of the menteri besar when the menteri besar has ceased to command the confidence of the majority of the assembly.
11.20 am : Cecil says trial judge wrong to follow Stephen Kalong Ningkan case as that did not have request for assembly dissolution.
11.10 am :Cecil says no express provision for motion of no confidence. Ruler can obtain view from other sources & ask MB to step down.
11.05 am : Cecil argues ruler has right of discretion to remove Nizar & appoint new MB under Article 16 (6).
11.03 am :Cecil says Article 16 (6) clear that Nizar must tender his resignation with his government. No provision to go to assembly for vote.
11.01 am : Cecil says ruler was correct to meet Najib, BN lawmakers & 3 independents before making decision on Feb 5.

Berita Terdahulu :
Mahkamah Rayuan akan mendengar rayuan Datuk Seri Dr Zambry Abdul Kadir terhadap keputusan Mahkamah Tinggi yang mengisytiharkan Datuk Seri Mohammad Nizar Jamaluddin sebagai Menteri Besar Perak yang sah pagi ini.
Mahkamah juga akan mendengar permohonan Mohammad Nizar bagi mengetepikan keputusan Mahkamah Rayuan yang membenarkan penangguhan pelaksanaan keputusan Mahkamah Tinggi.
Barisan peguam kedua-dua pihak mula memasuki mahkamah pada pukul 9 pagi tadi.
Mohammad Nizar tiba kira-kira 15 minit kemudian bersama isteri dan beberapa penyokongnya.
Pasukan polis kelihatan mula melakukan kawalan sejak awal pagi.
Isu perundangan melibatkan Dr Zambry dan Mohammad Nizar telah bermula sejak Februari lalu apabila Dr Zambry telah dilantik sebagai Menteri Besar menggantikan Mohammad Nizar selepas Barisan Nasional (BN) mengambil alih pemerintahan Perak daripada Pakatan Rakyat.
Berikutan itu, pada 13 Februari lalu, Nizar memfailkan permohonan untuk mengisytiharkan beliau sebagai Menteri Besar yang sah.
Kemudiannya pada 11 Mei, Mahkamah Tinggi memutuskan bahawa Mohammad Nizar sebagai Menteri Besar Perak yang sah.
Dr Zambry bagaimanapun membuat rayuan berhubung keputusan itu pada 12 Mei dan Mahkamah Rayuan membenarkan penangguhan keputusan Mahkamah Tinggi sehingga kes rayuan Dr Zambry selesai.
Mohammad Nizar keesokannya pula membuat permohonan bagi mengenepikan keputusan Mahkamah Rayuan itu bagi penangguhan pelaksanaan itu.
